Terms of Service

These terms are an agreement between you and Nieves Studio ("we", "us") covering the Keen Mind app and keenmind.io. By creating an account or using Keen Mind, you accept them. If you don't accept them, don't use the app.

1. Beta software

Keen Mind is in beta. Features change, processing sometimes fails, and recaps can be wrong. Keep your own notes for anything you can't afford to lose.

2. Your account

You need an account, and you must be at least 13 years old — or older if that's the age of digital consent where you live. Keep your login details to yourself; what happens under your account is your responsibility. Give us an email address you can actually receive mail at.

3. Recording responsibly

This is the important one. When you record a session, you are recording everyone at the table.

• You must tell everyone present that you are recording, and get their agreement, before you start.
• You must follow the recording and privacy laws where you are. In some places everyone present must consent.
• Don't record people who have refused, and don't record children without a parent's permission.
• If someone withdraws consent, delete the recording.

If you record someone without permission, that's on you, not on us. You agree to cover us for claims arising from recordings you make.

4. Your content

Your recordings, campaigns and notes remain yours. You grant us the licence needed to run the service: to store your content, send it to the providers listed in our Privacy Policy for transcription and recap generation, and show it back to you and the players you invite. That licence exists to operate Keen Mind and for nothing else. We don't use your content to train AI models, and we don't sell it.

5. Generated content

Recaps, NPC entries, quotes and the Bard's Tale are produced automatically from your recording. They can be inaccurate, incomplete, or put words in the wrong mouth. Read them as a convenience, not as a record of what was said. You're free to use them however you like within your game.

6. Acceptable use

Don't use Keen Mind to:

• record people without the consent described above;
• upload content you have no right to upload;
• store material that is illegal, abusive, or made to harass someone;
• break into, overload, or reverse engineer the service;
• resell the service or run it on someone else's behalf as your own product.

We may suspend or close accounts that do these things.

7. Subscriptions and payment

Keen Mind offers a free tier and a paid subscription. When paid subscriptions are available, they are billed through the App Store or Google Play under their terms, renew automatically until cancelled, and are cancelled through the store account that bought them — not by us. Refunds are handled by the store under its policy. Prices may change, with notice before a change affects you. Usage limits for each tier are shown in the app.

8. Availability

We try to keep Keen Mind running but don't promise it will be available or error-free. We may change or discontinue features. If we discontinue the service, we'll give reasonable notice and a chance to get your content out.

9. Ending it

You can delete your account in Settings at any time, which permanently removes your content. We may suspend or end your access if you break these terms.

10. No warranty

Keen Mind is provided "as is", without warranties of any kind, to the extent the law allows. We do not warrant that recaps are accurate or that recordings will always be captured, processed or retained successfully.

11. Limit of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost recordings, transcripts or generated content. Our total liability is limited to what you paid us in the twelve months before the claim. Some places don't allow these limits, in which case they apply to the extent permitted.

12. Changes to these terms

We may update these terms; the date above will change and significant changes will be announced in the app. Continuing to use Keen Mind after a change means you accept it.

13. Governing law

These terms are governed by the laws of the Commonwealth of Puerto Rico and the United States, without regard to conflict of law rules.
